Program Booking and Payment - Once you have selected your program and dates you will receive an email requesting a 50% deposit to confirm your booking, Program balance payment in full, along with your signed participation documents, must be received by Sailing Strong no later than 48 hours prior to the start of your scheduled program. Participation Requirements EQUIPMENT AND GEAR Participation in this sport occurs outside and on the water and is subject to variable weather conditions. It is your responsibility to bring and wear the appropriate clothing and sun protection. Also required are shoes with non-marking soles for any time spent on a sailboat and your own Transport Canada approved Personal Flotation Device. CONCUSSION POLICY I understand that Sailing Strong follows all protocols with regards to concussion as defined by Sail Canada protocols. I also understand that if I am under the age of 26, I am subject to the provisions of Rowan’s Law in Ontario. CODE OF CONDUCT I agree to abide by the code of conduct, anti-harrassment and Safe Sport policies as set by by Sail Canada and Ontario Sailing. Physical Requirements INTRODUCTION TO SAILING Participants will have the opportunity to experience sun, wind, spray, rain, and temperatures consistent with the time of year they take part in this activity. When underway the vessel may exhibit irregular motion due to wind and waves. Participants may be asked perform simple tasks at the dock and to move around the vessel when underway. If you walk down the dock with a smile, this session is for you! START KEELBOAT SAILING and BASIC CRUISING STANDARD These training sessions will require short periods of moderate upper body exertion, and a moderate level of arm strength. Participants will have the opportunity to experience sun, wind, spray, rain, and temperatures consistent with the time of year they take part in this activity. When underway the vessel may exhibit irregular motion due to wind and waves and temperatures may be cooler than on land. Participants will be expected to learn and demonstrate skills and perform tasks while the vessel is at the dock, at anchor, and when the vessel is underway. In a day sailing format, vessels will be underway for varying periods of time (up to 8 hours), during daylight, in light to moderate wind and sea conditions. These sessions are suitable for most fitness levels and will provide a good body core workout. Participants taking courses in “live aboard cruise and learn” formats may also be subject to conditions normally associated with the Intermediate Cruising standard. INTERMEDIATE CRUISING STANDARD These are offered as live aboard training courses. Participants will have the opportunity to experience sun, wind, spray, rain, and temperatures consistent with the time of year they take part in this activity. When underway the vessel may exhibit irregular motion due to wind and waves and temperatures may be cooler than on land. Participants will be expected to learn and demonstrate skills and to perform tasks while the vessel is at the dock, at anchor, and when the vessel is underway. Vessels will be underway for varying periods of time, primarily during daylight hours in light to strong wind and sea conditions. These training sessions will require short periods of moderate upper body exertion, as well as a moderate level of arm strength and core body fitness for handling lines and operating equipment. You will need to and focus for longer periods like when driving a car. No sweat, right? BAREBOAT CHARTER MASTER These are offered as live aboard courses and include periods (48 hours or more) of continuous passage making. Participants will have the opportunity to experience sun, wind, spray, rain, and temperatures consistent with the time of year they take part in this activity. When underway the vessel may exhibit irregular motion due to wind and waves and temperatures may be cooler than on land. Participants will be expected to move around the vessel day and night, to learn and demonstrate skills and to perform tasks while the vessel is at the dock, at anchor, and when the vessel is underway. Vessels will be underway both day and night in a wide range of conditions which may include large seas and strong winds. Participants will be challenged to work as a part of a team and operate the vessel for two or more days with limited or irregular periods of rest. These training sessions will require short periods of moderate upper body exertion, a moderate level of arm strength and some core body fitness and stamina. Cancellation Policies We appreciate your business and it’s an honour to help you get from where you are to where you want to be in the world of sailing. When you submit payment for a sailing course or assessment, we mobilize the boats, instructors, and secure the dates on the calendar. We often sell out. Please review the Cancellation-Rescheduling Policy prior to submitting payment for a sailing course or assessment. By submitting payment, you are agreeing to this policy. If you do not agree, please do not pay. Weather Sailing courses and clinics meet regardless of the weather. If rain is in the forecast, you will want to bring appropriate foul weather gear. We may choose to cancel or reschedule a class or assessment in the event of a gale warning, or if we have concerns about the safety of students and the vessel. If You Have to Cancel or Do Not Attend If you have paid for all or a portion of your course or assessment and you cancel for any reason up to 30 days in advance you will receive a refund of 90% of what you have paid. If you cancel within 30 days of your course or assessment, or simply do not attend, there is no refund. We will hold 50% of your payment as a credit for use on a future course or assessment within 12 months of the one you paid for. No refunds for NauticEd course materials. This is the policy we adhere to. If you do not agree, please do not pay. If We Have to Cancel If we cancel the course or assessment for any reason, we will offer a refund of the amount you paid us. There is no allowance for any other expenses you may have incurred. Rescheduling We really don’t want you to reschedule once you have paid for a class or clinic, because we’ve mobilized assets and instructors for the course. If you decide you must reschedule a course up to Basic Cruising Standard, we can do so for a $250.00 fee, provided you advise us at least two weeks prior to the start of your course. If you decide you must reschedule an Intermediate Cruising Standard, Bareboat Charter Master or SLC Challenge, provided you advise us at least three weeks in advance, we can do so for 50% of the course or assessment fee. Terms & Conditions/Waiver & Release of Liability READ BEFORE AGREEING By checking off the box below, I agree to the following terms and conditions of participating in the Programs provided by Sailing Strong 1. Medical Condition & Authorization. I certify that the named Participant is physically able to participate Sailing Strong programs. and that I know of no restrictions, physical impairments, or any other facts, which in any manner limit his/her participation in such a program. I also understand that Sailing Strong will administer no physical examinations and that Sailing Strong will rely solely upon the information submitted via forms. I give permission for Participant to receive emergency medical or surgical treatment and hospitalization if necessary. I hereby authorize directors, coaches, staff and associates of Sailing Strong to act on my behalf according to their best judgment in any emergency requiring medical or surgical treatment and hospitalization if necessary. 2. Financial Responsibility & Insurance. I will be financially responsible for any medical attention needed during the program duration or resulting from an injury received at during program participation. I represent that I have provided and maintain adequate health and medical insurance coverage for Participant covering any and all activities related to the program participation. My medical insurance shall be the insurance coverage for any medical treatment. I also understand and agree that Sailing Strong shall not assume, or be responsible or liable for expense, medical treatment, or compensation for any injury to the named Participant may suffer during Program participation or related activities. 3. Compliance with Program Participation Policies. Participant understands and agrees to comply with all of the Sailing Strong rules, policies and stated and customary terms, conditions or requirements for participation (Program Participation Policies) including any rules or conditions of any hotel or transportation service provider in which participant uses during their program participation. I/we agree that if you observe any unusual or significant concern in Participant’s readiness for participation in the Program or participant’s failure or unwillingness to comply with the Program Rules, you may, at your sole discretion, will remove participant from the participation and immediately inform the nearest Sailing Strong official. Also, I/we hereby release and forever discharge Sailing Strong, from any and all claims, actions, damages, or liabilities (including attorneys' fees and costs), arising from or related to any acts, actions, failures to act by Participant or Participant's disregard or failure to follow Program Rules. 4. Assumption of Risk of Program Activities. I understand the risk of injury to Participant from the activities involved in Program activities is significant, including the potential for permanent disability and death. The term “Program Activities” includes but is not limited to: travel to and from, activities on land and water, activities before and after instruction at any hotel or third party facilities at which a Program activity or function is conducted. While the particular Program rules, equipment and personal discipline may reduce this risk, the risk of serious injury does exist. I/we (Parent/Guardian and Participant) knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of Sailing Strong, and its Coaches, Instructors, Staff, Management, and Directors and I/we assume full responsibility for participation in Program by Participant. 5. Release & Hold Harmless. I/we for myself and on behalf of Participant hereby release and hold harmless Sailing Strong., and its Coaches, Staff, Management, Directors, Sponsors, Representatives, volunteers and if applicable the owners and lessors of the premises used to conduct Programs (Releasees) with respect to any and all injury, disability, death or loss or damage to person or property incident to participant’s involvement or participation in any and all Program activities whether arising from the negligence of releases or otherwise, to the fullest extent permitted by law. 6. Indemnity. I/we, for myself and on behalf of Participant, hereby indemnify and hold all of the above Releasees from any and all liabilities incident to Participant’s involvement or participation in any and all Program activities whether arising from the negligence of releases or otherwise, to the fullest extent permitted by law. 7. Payment: Registration must be paid in full prior to attending Programs. Payment can be made in full at time of registration. Final payment of the balance is due 7 days prior to the Program start date. Parent / legal guardian agrees to have payment in by that time. 8. Cancellation Policy: A full Program credit will be issued 30 days prior to the start of Sailing Strong program. Sailing Strong reserves the right to cancel a Program for any reason without prior notice. In this case, full refund is given for all monies collected by Sailing Strong only. Sailing Strong will not be responsible for refunds on airline flights, hotel reservations, or other incidental fees incurred in conjunction with the Program. I understand and agree Sailing Strong, retains the right to use, for publicity and advertising, photographs of Program Participants taken during Program participation. 10. Limitation of Liability: I agree that the total liability of Sailing Strong, its affiliates and respective directors, coaches, instructors officers, employees, and agents with respect to services performed or to be performed by Sailing Strong, shall not exceed 100% of the compensation received by Sailing Strong, from me pertaining to Participant. The parties agree and acknowledge this Section of the Agreement is a material part of the consideration for the Agreement. 11. Severability. In the event that any provision of these Terms and Conditions, or the application of any such provision to any person or set of circumstances, shall be determined to be invalid, unlawful or unenforceable, the remainder of these Terms and Conditions shall continue to be valid and enforceable to the fullest extent permitted by law. 12. Governing Law & Jurisdiction. These Terms and Conditions will be governed by the law of the jurisdiction in which the Program is conducted. I/we agree that any action brought under these Terms and Conditions shall be brought in the jurisdictional court. In the event either party commences an action under these Terms and Conditions, the prevailing party shall be entitled to reasonable attorneys fees and costs.
